GENERAL TERMS AND CONDITIONS OF PURCHASE 

These General Terms and Conditions of Purchase govern the use of the website es.3ina.com (hereinafter, the “Website”), owned by 3INA Cosmetics, S.L. (hereinafter “3INA”). 

 

1. IDENTIFICATION OF THE OWNER 

3INA Cosmetics, S.L. is a commercial company with its registered office at Calle Doctor Fourquet nº3, 28013, Madrid, holding Tax Identification Number (NIF) no. B87141305, registered in the Commercial Registry of Madrid, Volume 32,836, Book 0, Folio 190, Section 8, Sheet M-591.070, Entry 1, and with email address [email protected]

The use of the Website and the placement of orders implies full and unconditional acceptance of these General Terms and Conditions of Purchase in the version published at the time the order is placed.

3INA provides customers with a free Customer Service, accessible through the following means:

The service is provided in Spanish, with the possibility of assistance in co-official languages where applicable, and will attend to requests on business days, within the hours indicated in Clause 10. 


 

2. SCOPE OF THE CONTRACT 

These conditions apply to the sale of all products offered by 3INA through the Website, for shipments to the countries indicated therein. Customers within the EU have rights harmonised by Directive 2011/83/EU. 

If you do not reside in the indicated countries, you may only purchase items through the online store if the delivery address of the order is located in one of the countries or territories indicated on the Website. 

3INA informs that its Website is intended exclusively for users over 18 years of age. 

3INA reserves the right to cancel a customer’s access account if fraudulent, speculative, or bad faith actions are detected in the use of this service.
 

3. PURCHASE LIMIT 

For security reasons, purchases exceeding 1,000 euros, or with more than 100 items per order, cannot be made. 

Customers interested in making purchases above this amount must contact Customer Service, where they will be provided with information on how to proceed with the desired purchase.
 

4. PRICE 

The applicable prices are those indicated on the Website on the date of the order: 

All prices include VAT or other applicable indirect taxes, depending on the destination country. 

Shipping costs are shown separately before final order confirmation. 

Before making payment, the customer will see a full summary with the total price, including taxes and shipping. 

You can consult this information in the Shipping and Returns Policy section. Prices are displayed in euros, except for the United States and the United Kingdom, where they are displayed in US dollars and British pounds respectively.


5. PAYMENT 

Payment shall be made at the end of the purchase process and is a mandatory condition for its formalisation. Under no circumstances may payment be made later. 

Deferred payment methods such as cash on delivery or bank transfer are not accepted, in accordance with Article 60 bis of the TRLGDCU. 

Accepted payment methods: Visa, MasterCard, American Express, Shop Pay, Apple Pay, Google Pay, PayPal, and Amazon Pay.

In any case, the choice of payment method is made during the purchase process on the corresponding screen. 

3INA uses secure payment systems from leading financial institutions to provide maximum security. 

The customer must notify 3INA of any improper or fraudulent charge made on the card used for purchases, by email, as soon as possible so that appropriate actions may be taken. 

Payment providers or issuers may adopt anti-fraud measures that may result in the rejection of certain transactions. 3INA shall not be liable for the application of such security policies. 

You will receive the invoice in paper format; however, you may request at any time to receive the invoice in electronic format, in which case we will issue and send the invoice in that format. 

3INA warns that invoices cannot be modified afterwards in compliance with applicable regulations.
 

6. DELIVERY 

The delivery period shall be a maximum of 30 calendar days from the completion of the purchase. 

Estimated delivery time: 1–3 business days. 

Shipping costs: Shipping costs are detailed during the purchase process. The customer shall bear customs handling costs, as well as any taxes and duties generated by the order. 

Delivery incidents: Our shipping provider will send an email indicating the delivery date. If delivery cannot be completed due to the absence of the recipient, the courier company will contact you by email to arrange a new delivery. 

After two failed delivery attempts, and more than 14 calendar days from the first attempt, return procedures to the warehouse will begin. 

Orders may be subject to customs controls in the destination country. These controls are completely outside of 3INA’s control and may generate additional delays exceeding the indicative delivery times. 

3INA shall not be liable for delays resulting from customs authorities, inspections, holds, or any other mandatory border procedures. 

In the event of a customs delay, 3INA will inform the customer as soon as it becomes aware and will provide, as far as possible, the available information regarding the shipment status.
 

7. RETURNS AND WITHDRAWAL 

Return: due to a defect, fault, or receipt of an incorrect product.
Withdrawal: due to the customer’s decision. 

7.1 Due to the special characteristics of certain products, the following must be taken into account: 

Returns or withdrawals are not accepted, for health and hygiene reasons, when the packaging, wrapping, or hygiene seal protecting the product has been opened, except in the case of defective or faulty products. 

The 14-calendar-day withdrawal right provided in these Terms applies in accordance with European Union regulations and is therefore only mandatory for customers whose habitual residence is in an EU Member State. 

For customers residing outside the European Union, the right of withdrawal shall only apply where required by the mandatory law of the customer’s country of residence, or where 3INA voluntarily offers it under the same conditions as EU customers. 

Products to be returned must be properly packaged, in perfect condition, and unused: 

(i) Returns involving nail polish and aerosols must be carried out via a non-air transport service  (ii) Product sets are indivisible and their items cannot be returned separately.

 

7.2 Conditions, refund, costs, and procedure: 

Conditions (Withdrawal): You have 14 calendar days from receipt of the product(s) to withdraw from the contract without providing any justification. 

Conditions (Returns): 3INA shall be liable for lack of conformity that arises within the period established by law. 

Refund (Withdrawal/Return): 3INA will refund the corresponding amount, including the initial shipping costs, without undue delay and in any case within 14 calendar days from the date it was informed of the return. Refunds will be made using the same payment method used for the original purchase. However, we may withhold the refund until the products have been received, or until you have provided proof of return, whichever occurs first. 

Costs (Withdrawal): The customer shall bear the costs of returning the product(s). 

Costs (Return): 3INA shall bear all return costs. The customer may choose between a replacement product in perfect condition, the correct item, or a refund.

Once we receive your email, we will process the return within 2–3 business days.
 

8. PRODUCT AVAILABILITY 

If there are supply issues or products are out of stock, the customer will be informed immediately. 

The customer may choose another product of the same or lower value, or request a refund. In this case, 3INA will refund the amount without undue delay and in any case within 14 calendar days. 

Refunds will be made in accordance with Clause 7. 

9. WARRANTY OF PURCHASED PRODUCTS 

All products are covered by the legal conformity warranty (3 years from the date of purchase) as provided under Royal Decree-Law 7/2021, of April 27. 

To request the application of the warranty, the customer must contact Customer Service (Clause 10). 3INA will assess the issue and, where applicable, offer solutions covered by the warranty: product repair or replacement with an identical or equivalent product, both at no cost to the customer. 

If repair or replacement is not possible, the customer may choose between a price reduction or termination of the contract with full refund. 

The 3-year legal warranty applies in accordance with EU law and is therefore only mandatory for customers residing in the EU. 

For customers residing outside the European Union, warranty duration and scope shall be governed by the mandatory law of the customer’s country of residence.

Customer Service will respond as soon as possible, and in any case within a maximum of 15 business days. 

11. MODIFICATION OF GENERAL TERMS 

3INA reserves the right to modify these General Terms and Conditions at any time. The new terms shall only apply to purchases made after their publication. No modification shall affect orders already in process. 


12. FORCE MAJEURE 

3INA’s performance of all or part of its obligations shall be suspended in the event of force majeure preventing or delaying performance. 

Such events include, but are not limited to: war, riots, insurrection, social unrest, strikes of any nature, natural disasters, and supply issues not attributable to 3INA. 

3INA will inform the customer of such event within seven days of its occurrence. 

If such suspension lasts more than fifteen days, the customer may cancel the order in progress and will be refunded in accordance with Clause 7. 


13. APPLICABLE LAW AND JURISDICTION 

These General Terms and Conditions are governed by Spanish law. 

Without prejudice to the above, the consumer also benefits from the mandatory protections of the law of the country of residence. 

The parties submit, at their choice, to the courts of the customer’s domicile for the resolution of disputes. 

The processing of personal data arising from online purchases, account management, invoicing, and subscriptions is governed by our Privacy Policy and Cookies Policy available on the Website.
